These terms govern your use of the financial management consulting, business performance analysis, and strategic financial advisory services provided by MyFinancialController for South African SMEs. By accessing or using our services, you agree to be bound by these terms.
MyFinancialController provides financial consulting and advisory services, including but not limited to cash flow forecasting, tax planning, financial ratio analysis, and strategic planning. All services are delivered on a non-exclusive basis and are subject to a separate engagement letter that defines the specific scope, deliverables, and fees for each project or retainer.
You agree to provide accurate, complete, and timely financial information and documentation as reasonably required for the performance of services. You are responsible for the implementation of any recommendations provided, and MyFinancialController does not guarantee specific financial outcomes or business results.
To the maximum extent permitted by South African law, MyFinancialController shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or the inability to use them, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to these terms or our services shall not exceed the total fees paid by you for the specific service giving rise to the claim during the twelve months preceding the claim.
All reports, analyses, methodologies, and materials provided by MyFinancialController remain our intellectual property. You receive a non-transferable, non-exclusive license to use such materials for your internal business purposes only. You may not reproduce, distribute, or create derivative works without our prior written consent.
Both parties agree to maintain the confidentiality of all non-public information shared during the course of the engagement. This obligation survives the termination of these terms. MyFinancialController may disclose information if required by law or regulatory authority.
Either party may terminate these terms or any engagement letter with 30 days' written notice. Upon termination, you must pay all fees due for services rendered up to the effective date. Sections 3, 4, 5, and 7 shall survive termination.
These terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or relating to these terms shall first be attempted to be resolved through good-faith negotiations. If unresolved, the dispute shall be submitted to mediation in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).
We may update these terms from time to time. The most current version will be posted on this page, and your continued use of our services after any changes constitutes acceptance of the updated terms. Material changes will be communicated via email to the address you have provided.
